Easy FCP

Terms of Service

Effective 5 November 2026

English is the authoritative version of these terms. A Simplified Chinese translation is provided for convenience; if there is any inconsistency, the English version prevails.

These terms are an agreement between Mtime Ltd, a New Zealand company (GST 098-632-840) (“we”, “us”), and the business that uses Easy FCP (“you”). By creating an account or starting a trial you agree to these terms and to our Privacy Policy.

1. The Service

Easy FCP is an online tool that helps food businesses in New Zealand keep digital Food Control Plan (FCP) records, such as temperature, cooling, cleaning and pre-cook logs, and produce reports. A free local mode without login is also available, in which data is stored only on your device; these terms apply to that mode too, except the billing terms.

2. Accounts and eligibility

The Service is for businesses. By using it you confirm that you are acquiring it for the purposes of a business and that the person accepting these terms is authorised to do so for the business. You are responsible for your login, for everyone you give access to (such as staff), and for the accuracy of what is entered.

3. Trial, subscription and billing

4. Business use: Consumer Guarantees Act and Fair Trading Act

Because you are acquiring the Service in trade, the parties agree that, to the extent permitted by law, the Consumer Guarantees Act 1993 does not apply (section 43 of that Act), and sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply (section 5D of that Act). The parties agree it is fair and reasonable to be bound by this clause.

5. Your responsibility for food safety

Easy FCP is a record-keeping tool. It is not legal, food-safety or professional advice, and does not replace your registered Food Control Plan, MPI guidance or your verifier. You remain fully responsible for food safety, for complying with the Food Act 2014 and your FCP, and for the accuracy and completeness of your records. We do not guarantee any verification or inspection outcome. You must keep your records for the period required by law (generally at least 4 years), including by exporting them.

6. Acceptable use

You must not: misuse or try to break or bypass the security of the Service; access other businesses’ data; enter false records intended to mislead a verifier or regulator; use the Service unlawfully; or resell it without our permission.

7. Your data

You own the data you enter. You give us permission to store and process it only to provide the Service, as described in our Privacy Policy. You can export your data while you have an account; it is deleted 24 months after cancellation or the end of the Service.

8. Availability and no warranty

We aim to keep the Service available and reliable, but it is provided “as is” and “as available”. To the extent permitted by law, we do not warrant that it will be uninterrupted, error-free or meet every requirement. Planned maintenance, outages and internet problems can happen; the app can keep some records on your device while offline. Keep regular exports.

9. Limitation of liability

To the extent permitted by law: we are not liable for any indirect or consequential loss, loss of profit, revenue or business, or any fine, penalty or regulatory outcome; and our total liability to you in connection with the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Termination

You can stop using the Service and cancel at any time. We may suspend or end your account if you seriously or repeatedly breach these terms or do not pay, or if we stop providing the Service, giving reasonable notice where practicable so you can export your data.

11. Changes to terms or price

We may change these terms or the price. We will give at least 30 days’ notice by email or in the app before a change that affects you takes effect. If you do not agree, you can cancel before the change applies.

12. General

These terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction. If any part is unenforceable, the rest continues to apply. Questions: [email protected].
